Kamio Pty Ltd ACN 620 109 499 ("Kamio", "we" or “our") manages the information that we collect from you in accordance with all applicable privacy legislation in Australia.
1. COLLECTION OF YOUR PERSONAL INFORMATION
1.1. Kamio provides a unique, innovative, marketplace which allows Brands to find and connect with Talent for the performance of Roles and for Talent to advertise their performance skills or attributes to Brands. If you choose to not provide the information requested by us it may mean that we are unable to provide some or all of our Services to you.
1.2. Kamio collects personal information when you sign up and create a Kamio account and use our Services including the private messaging system, creating a Role, making a counter-offer to a Brand and Q&A for a Role. Information collected may include, but is not limited to, your name, address, phone number, contact details, birth date, gender, physical attributes, credit card and account details, bank account details, occupation and interests. We might also give you the option of providing a photo or video to be associated with your Kamio user ID. If your personal details change, it is your responsibility to update your Kamio account with those changes, so that we can keep our records complete, accurate and up to date.
1.4. Certain information is created and recorded automatically when you use the Kamio Platform, including:
(a) Information about your actual location (for example, GPS signals sent by your mobile device). We may use a range of different technologies to confirm your location.
(b) Information that your browser sends whenever you visit a website or that your mobile app sends when you are using it (“Log data"). Log data includes your internet address, browser time and settings, the date and time of your request, how you used the Kamio Platform and cookie data.
(c) Cookies or similar technology to record data which might include your personal settings or information;
(d) Information about the device you use to access the Kamio Platform (including the type of device and system you use on it); and
(e)Your page requests.
1.5. You are not anonymous to us when you log into the Kamio Platform or post any content (including Roles, offers, counter-offers, comments or feedback) on the Kamio Platform.
1.6. To enable us to improve our existing Services and to create new service features, Kamio may collect, and share with other users and service providers on Kamio, information about the way you use our Services, including (but not limited to) the transactions you enter into on the Kamio Platform, your feedback rating, the Offers or counter-offers you make, the comments you post, and the transactions you enter into with our valued affiliate service providers.
2. HOW YOUR INFORMATION IS USED
2.1. Other than material that you voluntarily choose to post on the Kamio Platform (such as Roles, Q&A for Roles and feedback), the only information we will post publicly is your Kamio public profile.
2.2. When you communicate or post on a public forum on the Kamio Platform (including to post a Role, make an Offer, comment on a Role, or provide feedback on other users), your user ID and all the material that you post is visible to other users and is publicly available to other internet users. We strongly encourage you to use discretion and exercise caution when posting anything to the Kamio Platform. Kamio does not in any way control, and does not accept any responsibility or liability whatsoever for, the disclosure or use of personal information which is voluntarily posted by you in any publicly accessible area of the Kamio Platform.
2.3. Kamio uses the information collected to:
(a) provide, maintain, protect and improve the Services, the Kamio Platform and our users experience;
(b) develop new products;
(c) protect our interests and the interests of all our users;
(d) identify and authenticate users and information posted to the Kamio Platform;
(e) customise the content for each user;
(f) customise any advertising displayed on the Kamio Platform to the user;
(g) develop new service features;
(h) ensure that Kamio receives payment of the fees due to it;
(i) contact you (for example, to inform you about upcoming changes or improvements to our Services);
(j) conduct research;
(k) expand our user base;
(l) develop our relationships with affiliated service providers; and
(m) generate data reports on an aggregated, non-personally identifiable basis, for both internal and third party use, but subject to any applicable laws (for example, We may show advertisers or investors trends relating to the general use of Kamio's Services).
2.4. You acknowledge and agree that Kamio will provide your personal information:
(a)to a user with whom you have formed a Talent Contract via the Kamio Platform; and
(b)as required by law, order of a court, tribunal or regulator or if Kamio reasonably believes that the use or disclosure of the information is reasonably necessary for enforcement related activities.
2.5. Your contact information may also be used for accounting, invoicing and billing purposes, marketing purposes, by third party service providers to Kamio, and to respond to any enquiry you make, in some cases information we collect is transferred overseas. When you contact Kamio, we may keep a record of the communication(s) between you and Kamio to help resolve any issues you might have. If other user(s) of the Kamio Platform already have your userID (or other information identifying you), and you have chosen to upload a photo or other personal information to your Kamio account, we may show those user(s) that personal information.
3. COOKIES AND ANONYMOUS IDENTIFIERS
3.1. Your computer or device may store an identifying cookie or anonymous identifier, for your Kamio account and your access to the Kamio Platform. This can save you time each time you re-visit the Kamio Platform, by accessing your information when you sign-in to Kamio.
3.3. You agree that if you change the settings on your internet browser to block or restrict cookies associated with our Services, or to indicate when a cookie is being sent by Kamio, our Services may not work as intended. You should remember that, while you may still be able to use the Kamio Platform if your cookies are disabled, our Services may not function properly on your device and you may not be able to take advantage of certain features of the Kamio Platform.
4. STORING AND PROTECTING PERSONAL INFORMATION
4.1. We store and process your personal information in Australia.
4.2. We require our employees and contractors to protect the confidentiality of the personal information we hold.
4.3. We will use commercially reasonable safeguards to keep your personal information secure.
4.4. We will retain personal information until we no longer require it for the purposes it was collected for. We may need to retain information about complaints for several years.
4.5. We will verify your identity before granting you access to your account by requesting your unique password.
4.6. We will take all reasonable steps to protect the information we hold about you from unauthorised access, use and disclosure, however we cannot guarantee the absolute security of that information, or that our systems will be completely free from third party interception or are incorruptible from viruses. We cannot and do not guarantee that information you send from your computer to us over the Internet will be protected by any form of encryption (encoding software). In light of this, we cannot and do not ensure or warrant the security or privacy of your personal information, including payment and account details. You transmit your personal information to us at your own risk.
4.7. You are entirely responsible for maintaining the security of your passwords and/or account information.
5.4. Third-party vendors, including Google, may show Kamio advertisements on sites across the Internet.
6.1. When you register on the Kamio Platform you may be given the opportunity to elect (“opt-in") to receive updates on our latest Services, news and special offers, and those of our valued affiliate service providers (“Marketing Material"), via your Kamio account, personal e-mail address, post or telephone. If you conclude a transaction on the Kamio Platform, you may also be given the opportunity to opt- in to receive Marketing Material from Kamio and our valued affiliated service providers.
6.2. Once you opt-in to receive Marketing Material, You may, at any time, opt-out of receiving Marketing Material. To opt-out go to the 'Manage Account' link on the Kamio Platform, choose 'Settings', then 'Alerts' and update your preferences. You can also click on the "unsubscribe" link in any email containing Marketing Material that we send you, or you can request an opt-out by emailing Kamio using the contact information provided on the Kamio Platform. If you no longer consent to receiving Marketing Material then you must opt-out in one of these ways.
6.4. Kamio uses Remarketing with Google Analytics to advertise online. Using the Ads Settings in a personal Google account, visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network advertisements.
6.5. Third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimise, and serve ads based on someone's past visits to the Kamio Platform.
6.6. Using the Ads Settings in a personal Google account, visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads.
7. ADMINISTRATIVE COMMUNICATIONS
7.1. Kamio reserves the right to send you administrative and account-related messages that you may not opt-out of. To cease all communications to you from Kamio you must close down your Kamio account.
8. ACCESSING AND CHANGING PERSONAL INFORMATION
8.1. We will allow you, at any time, to access, edit, update or delete the personal information that we hold about you, unless:
(a) we are legally permitted or required to deny you access to, and/ or to retain, the information; or
(b) you make request(s) that are unreasonably repetitive, require Kamio to make a disproportionate technical effort (for example, to develop an entirely new system), risk the privacy of others, or would be highly impractical to comply with.
8.2. If you wish to access the personal information we hold about you, or to delete your Kamio account, you should contact Kamio using the contact us feature of the Kamio platform.
8.3.We need to prevent information in our systems from being accidentally or maliciously destroyed. This means that, where you delete information from our Services, residual copies of that information on our active servers, as well as any corresponding information on our back-up systems, may not be immediately deleted.
